Andrew F. Pierce obtained a complete dismissal, pursuant to a settlement, of a lawsuit against landowner for code violations based on erecting a sunshade for agricultural purposes in a remote area of Santa Cruz County.
Pierce & Shearer wins Anti-SLAPP motion and vindicates First Amendment rights of local homeowner. In December 2015, the Hon. William J. Elving of Santa Clara County Superior Court granted the Anti-SLAPP motion dismissing all claims brought by a construction company against an individual homeowner in Mountain View. The homeowner had posted on her personal blogs a description of her negative experience with the construction company. The company sued the homeowner for damages and to prevent her from posting any negative statements on the internet. Judge Elving dismissed all claims on the grounds that the First Amendment protected the blog postings and that it was unlikely the construction company could win on any of its claims. Partner Scott A. Berman drafted and argued the motion on behalf of the homeowner.
Pierce & Shearer successfully argues on behalf of Palo Alto landowners. Andrew Pierce, retained by 14 residents, argued that an ordinance to widen sidewalks along El Camino Real would result in an unconstitutional taking of land.
