ERISA Litigation
ERISA is an acronym for Employee Retirement Income Security Act of 1974.  It is a federal statute that governs certain types of employee benefits, including life, health and disability policies issued to employees by their employers.  Insurance policies written for members of employee groups are subject to the ERISA remedies to enforce such policies.  We represent plan participants when their claims for benefits are denied, from the initial appeal of the denial of benefits, through a federal court lawsuit and appeal, if necessary.  (We strongly recommend that you hire an attorney before filing a lawsuit, because your case may be limited to whatever evidence you present at the appeal.)  Contact Pierce & Shearer LLP when you are confronted with denial of a claim under a disability, life insurance or annuity plan governed by ERISA.

Counseling and Advice
Although we are comfortable in the courtroom, we recognize that it is generally in our clients' interest to avoid litigation.  With that in mind, we offer sophisticated  negotiation skills, making every effort to economically resolve disputes before lawsuits are filed.  We also alert our clients to potential issues before conflicts arise, and we prepare and review employment related documents designed to prevent costly litigation.
